Cancellation and Refund Policy
Please note:
- Forest permits and Hotel bookings are strictly non-refundable and non-transferable under their policy.
Forest permits and Hotel bookings charges shall be deducted first from the total amount. - The client holds the liability to pay the dues by confirming the booking. The payment schedule given is for the convenience and not to defer the dues. The agency makes payment to the channel partners for the tour 150 days before the tour date, and hence, the total amount payable by the client is to be considered while calculating refunds.
- Refunds on the remaining amount shall be governed as follows:
All refunds shall apply exclusively to the balance remaining after deduction of non-refundable expenses, including forest permits and hotel bookings. The refund amount, if applicable, will be calculated strictly based on the number of days remaining before the tour commencement date, in accordance with the cancellation policy outlined below:
Period of cancellation
- More than 90 days: 75% Refund
- 45 to 90 days: 50% Refund
- Less than 45 days to the tour: No Refund
1. In case of tour cancellation by the Agency due to Force Majeure, a full refund shall be issued, including non-recoverable third-party costs.
2. Refunds shall be processed within 10 business days.
Liability and Insurance
The Agency will not be held responsible for any losses, damages, injuries, death or additional expenses suffered by the Client due to causes beyond the Agency’s control. These causes include, but are not limited to:
Force Majeure Events
- Natural Disasters: This includes events such as earthquakes, floods, hurricanes, and other severe weather events that could disrupt travel plans.
- Acts of Terrorism: This includes any acts of violence or threats intended to disrupt travel and cause fear.
- Civil Unrest: This includes riots, strikes, or other forms of civil disorder that could make travel unsafe.
Accidents
- The Client must obtain comprehensive travel insurance, including medical evacuation and trip cancellation coverage. Failure to obtain such insurance shall be deemed a voluntary assumption of risk by the Client.
- Travel Accidents: This includes accidents that occur while travelling, such as car accidents, plane crashes, or other transportation-related accidents.
- Accommodation Accidents: This includes accidents that occur at the booked accommodations, such as slips, falls, or other incidents.
Insurance Recommendation
- Comprehensive Travel Insurance: The Client is strongly advised to procure comprehensive travel insurance to cover such eventualities. This insurance should cover medical expenses, trip cancellation, lost luggage, flight accident, and other losses incurred while travelling.
Insurance Provider: The Client is free to choose their own insurance provider. The Agency can provide recommendations if needed.
Insurance Confirmation: The Client should provide the Agency with confirmation of their travel insurance before the service commencement date. This ensures the Agency can assist the Client in the event of an emergency.
Governing Law
Jurisdiction
- Exclusive Jurisdiction: Any legal actions, claims, or disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Delhi, India.
- Submission to Jurisdiction: By entering into this Agreement, the Client and the Agency agree to submit to the jurisdiction of the courts of Delhi for any legal proceedings arising out of this Agreement.
- Venue: The parties agree that any legal proceedings will be conducted in the county or district where the Agency’s principal office is located.
Applicable Law
- Interpretation of Agreement: This Agreement will be interpreted in accordance with the laws of Delhi. This includes any issues relating to the validity, interpretation, or enforcement of the Agreement.
- Resolution of Disputes: Any disputes arising under or in connection with this Agreement will be resolved in accordance with the laws of Delhi. This includes any issues relating to the Services, payment terms, cancellation and refunds, or any other aspect of this Agreement.
- Compliance with Laws: The Client and the Agency agree to comply with all applicable laws of Delhi in performing their respective obligations under this Agreement. This includes any laws relating to travel services, consumer protection, data protection, and health and safety.
- Legal Advice: The Client and the Agency are advised to seek independent legal advice before entering into this Agreement. This ensures that both parties fully understand their rights and obligations under the Agreement.
Legal Actions
- Initiation of Legal Actions: Either party may initiate legal actions, claims, or disputes arising under or in connection with this Agreement.
- Notice of Legal Actions: The party initiating legal action must provide the other party with written notice of the action. This notice must include a description of the dispute, the relief sought, and any relevant supporting documentation.
- Response to Legal Actions: The party receiving notice of legal action must respond within the time period specified in the notice. Failure to respond may result in a default judgment in favour of the initiating party.
- Resolution of Legal Actions: The parties agree to make a good-faith effort to resolve any legal actions, claims, or disputes arising under or in connection with this Agreement before resorting to litigation.
- Costs of Legal Actions: Unless otherwise provided in this Agreement, each party will bear its own costs and expenses in connection with any legal actions, claims, or disputes arising under or in connection with this Agreement.
- Enforcement of Judgment: Any judgment or order issued by the courts of Delhi will be binding on the parties and may be enforced in any jurisdiction where the parties have assets.
